These Terms and Conditions govern your use of performadigitech.com and the services provided by Performa DigiTech Solutions ("we", "us", "our"). By using the website or engaging our services, you agree to these terms.

1. Services

We provide digital marketing services including SEO, AI search optimization, local SEO, Google Ads, Meta Ads, performance marketing, social media marketing, website development and graphic design. The exact scope, deliverables, timeline and fees for each client are set out in a written proposal or agreement, which takes priority over these general terms.

2. Fees and Payment

• Fees are quoted after an audit or discussion and confirmed in writing before work starts.
• Monthly retainers are billed in advance unless agreed otherwise. One-time projects may require an advance payment.
• Advertising spend on Google, Meta or other platforms is paid by the client directly to the platform and is separate from our management fee.
• Late payments may lead to work being paused until the account is cleared.

3. Client Responsibilities

• Provide accurate business information, timely approvals and the account access needed to deliver the work.
• Ensure that any content, images, logos or claims you supply are accurate and that you have the right to use them.
• Comply with the advertising policies of Google, Meta and other platforms.

4. Results

We follow proven practices and work to improve rankings, leads and return on ad spend. However, search engines and ad platforms are controlled by third parties and change their systems often. We therefore do not guarantee specific rankings, traffic, leads or revenue. Past results shown on this website do not guarantee future performance.

5. Ownership

You own your ad accounts, analytics properties, Google Business Profile, domain and the data in them. On full payment, you own the website files and creative assets we produce specifically for you, except third-party tools, plugins, fonts or stock media, which remain subject to their own licences.

6. Term and Cancellation

Monthly retainers continue month to month and can be cancelled by either side with written notice before the next billing cycle. Fees already paid for work started or delivered are not refundable. One-time projects follow the cancellation terms in their proposal.

7. Confidentiality

We keep your business information confidential and use it only to deliver our services. We may show anonymised results, such as screenshots with names hidden, in our portfolio unless you ask us not to.

8. Limitation of Liability

To the extent allowed by law, our total liability for any claim related to our services is limited to the fees you paid us in the three months before the claim. We are not liable for indirect losses, lost profits, platform suspensions or changes made by third-party platforms.

The content on this website is for general information. You may not copy, reproduce or republish it without our written permission.

10. Governing Law

These terms are governed by the laws of India. Any dispute is subject to the jurisdiction of the courts in Dehradun, Uttarakhand.
